T-Mobile Polska

<p>T-Mobile Polska offers services based on our own telecommunication network, which is interconnected with other operators&rsquo; telecommunication networks, allowing the communication between T-Mobile Polska subscribers and other operators&rsquo; subscribers.</p>

<p>T-Mobile Polska has a&nbsp;network structure that ensures efficient expansion and reconfiguration in order to adapt to new requirements related to the development of the telecommunications market.</p>

<p>TMPL has two separated fixed networks to which telecommunications access is granted via Network Connection Points dedicated to each network:</p>

<ul>
	<li><strong>Fixed network of T-Mobile Polska F (&ldquo;TMPL/F Network&rdquo;)</strong>&nbsp;&mdash; fixed-line public telephone network using transmission systems and switching or rerouting devices to render publicly available telecommunications services, identified by being assigned Catalogue Numbers.</li>
	<li><strong>Fixed network of T-Mobile Polska G (&ldquo;TMPL/G Network&rdquo;)</strong>&nbsp;&mdash; fixed-line public telephone network using transmission systems and switching or rerouting devices to render publicly available telecommunications services, identified by being assigned Catalogue Numbers (formerly GTS Poland fixed-line public telephone network).</li>

<p>T-Mobile Polska/F Point of Interconnection service areas have been defined in the T-Mobile Polska fixed network. The number and location of these Points of Interconnection has an influence on the involved network elements (exchanges), whose resources are used for establishing a&nbsp;connection. Therefore, based on the information on the network provided by the operator requesting telecommunication access, the actual number and location of the interconnection points may be optimized.</p>

<p>T-Mobile Polska/G Point of Interconnection service areas have been defined in the T-Mobile Polska fixed network. The number and location of these Points of Interconnection has an influence on the involved network elements (exchanges), whose resources are used for establishing a&nbsp;connection. Therefore, based on the information on the network provided by the operator requesting telecommunication access, the actual number and location of the interconnection points may be optimized.<br />

Description of fixed-line public telephone networks

<p>In order to provide telecommunications access for the provision of termination services on the fixed network, the Operator and T-Mobile Polska are obliged to the following rules related to the use of the network:</p>

<ul>
	<li>each operator is responsible for its own network and is required to operate its network and establish rules of cooperation with third parties in such a&nbsp;way as not to cause damage or interference to the networks of other operators;</li>
	<li>each operator ensures the smooth operation of their network and is responsible for maintaining the correct performance of the devices on their side of the Physical Points of Interconnection and for the correct operation of their network connection points;</li>
	<li>in the event of an accident/failure, provided that this does not affect the attainment of network connections of other operators, issues shall be resolved by the operator of the faulty equipment;</li>
	<li>no operator will be allowed to connect, or agree to connect to their network, any networks of other operators or equipment that do not meet the requirements of the law.</li>
	<li>each operator is obliged to terminate calls in the T-Mobile Polska fixed network only through the Point of Interconnection.</li>
</ul>


Terms of use of the T-Mobile Polska public switched telephone network

Terms and conditions for the provision of termination of connection in the T-Mobile polska fixed network service

<p>After signing the agreement for telecommunications access, upon the request of the Operator, the process related to the implementation of the Point of Interconnection will begin. The implementation of the Point of Interconnection consists of the following basic steps:</p>

<ol>
	<li><strong>Building of a&nbsp;Physical Point of Interconnection</strong>&nbsp;&ndash; building time depends on the networks connection mode chosen by the Operator and local technical conditions for the construction of the Physical Point of Interconnection.</li>
	<li><strong>Connecting the trial configuration</strong>&nbsp;&ndash; 4 weeks;</li>
	<li><strong>SS7 signalling tests and connection recording tests</strong>&nbsp;&mdash; 8 weeks;</li>
	<li><strong>Physical Point of Interconnection upgrade for final configuration</strong>&nbsp;&ndash; 4 weeks;</li>
	<li><strong>Commercial initiation of the Point of Interconnection</strong>&nbsp;&ndash; 2 weeks. Telecommunication traffic can be exchanged upon the commercial initiation of the Point of Interconnection.</li>
</ol>

<p>Points of Interconnection between the T-Mobile Polska network and the Operator network will be created based on the E1 links bundle. The minimum configuration of the Point of Interconnection is made of 2 E1 links and 2 C7 channels (understood as timeslots of 64kbit/s size). This is a&nbsp;security measure (against the failure of a&nbsp;SS7 terminal).</p>

<p>T-Mobile Polska allows for the construction of a&nbsp;Physical Point of Interconnection with the following modes:</p>

<ul>
	<li>Collocation at the E1 connection level;</li>
	<li>Collocation at the STM-1 connection level + de-multiplexing;</li>
	<li>Lease of the STM-1 Transmission Link + de-multiplexing;</li>
	<li>Lease of the E1 level Transmission Link.</li>
</ul>

<p>The decision to build a&nbsp;Physical Point of Interconnection for the above modes will be preceded by a&nbsp;technical analysis by T-Mobile Polska intended to define the technical possibilities of building the Physical Point of Interconnection.</p>

<p>Points of Interconnection are localized at T-Mobile Polska exchanges and are realized through transmission links of 2Mbit/s capacity according to the recommendations ITU-T G.703 and G.732. In the transmission layer, both optical and electrical interfaces may be used at the level of SDH standard on the STM-1 links level.</p>


Points of interconnection implementation and technical specifications of devices

<h2>Fees for the services rendered by T-Mobile Polska</h2>

<p>Decision of the President of the Office of Electronic Communications of 26 October 2011; ref.: DART-SMP-6040-5/11(22) (hereinafter: &quot;Decision&quot;) introduces the obligation of T-Mobile Polska setting fees for the termination of calls within the T-Mobile Polska telephone network, in accordance with the schedule included therein, by 31 December 2012. Due to the above, from 1 January 2013, fees for the termination of calls within the public fixed-line telephone network of T-Mobile Polska were set on the level determined before issuing the SMP decision. These fees are set in Table 1.</p>

The fees specified above do not include VAT. Fees for the activities/processes related to the implementation of the Point of Interconnection in the Collocation Mode and the Transmission Link Lease Mode are defined individually.<br />
<br />
An operator requesting the provision of telecommunications access must provide complete financial statements and legalization documents. Based on these documents, the financial credibility of the Operator is evaluated, and a&nbsp;decision is made about the need for a&nbsp;security deposit, the type of deposit and its amount.<br />
<br />
To protect against claims arising from agreement concluded by T-Mobile Polska for telecommunications access, the Operator, before the commercial launch of a&nbsp;Point of Interconnection, must present the financial securities specified above. The amount of securities is calculated based on the forecasted traffic transmitted by the inter-network E1 connections, the payment cycles and the applicable rates.<br />
<br />
If there is a&nbsp;need to use more links, the amount of financial securities may be increased. The amount and form of the security submitted by the Operator may change depending on the traffic volume and timeliness of the payment by the Operator, and its financial condition.<br />
<br />
In case of payment delays by the Operator, T-Mobile Polska claims the right to block inter-network traffic. T-Mobile Polska will provide notice in writing of this at least two weeks in advance.<br />
<br />
This information does not constitute an offer within the meaning of the Civil Code provisions. The final rules detailing cooperation, billing, form and amount of the securities will be determined through negotiations taking into account the specifics of the selected telecommunications solutions and will be formalized by the signing of an agreement for network connection.

Fees

<h2>Physical Point of Interconnection</h2>

<p>Physical point of connecting the networks (transmission medium or device) of the Operator and T-Mobile Polska. A&nbsp;Physical Point of Interconnection is also a&nbsp;demarcation line in terms of who holds responsibility for the maintenance of the transmission connections.<br />
&nbsp;</p>

<h2>Peak Traffic Hours</h2>

<p>(PTH) &ndash; a&nbsp;continuous one-hour time interval during the day during which aggregated traffic is the greatest in volume.<br />
<br />
&nbsp;</p>

<h2>Leased Link</h2>

<p>T-Mobile Polska network resources carrying out transmission of a&nbsp;specific rate between T-Mobile Polska exchange and a&nbsp;Physical Point of Interconnection not owned by the Operator, yet used by them based on the implementation of a&nbsp;Point of Interconnection agreement.</p>
&nbsp;

<h2>T-Mobile Polska Transit Area</h2>

<p>Geographical area consisting of one or more numbering zones, according to Polish standards.</p>

<h2>Operator</h2>

<p>A telecommunication entrepreneur delivering public telecommunication networks.<br />

<h2>Point of Interconnection</h2>

<p>A place where the traffic and signalling between the Operator and T-Mobile Polska is exchanged.<br />

<h2>Excessive Traffic</h2>

<p>Telecommunications traffic that cannot be carried through a&nbsp;given Point of Interconnection due to the limited capacity of that Point.<br />

<h2>Real Connection Time</h2>

<p>The duration of every single inter-network traffic connection taking into account each started second of a&nbsp;connection, measured in full seconds from the second the called party or device answers until the end of the connection.<br />
