<h2>Public Land Mobile Network description</h2>
<br />
T-Mobile Polska (T-Mobile Polska), as a&nbsp;telecommunication network operator, offers services based on own telecommunication network, which is interconnected with other operators&rsquo; telecommunication networks, allowing communication between T-Mobile Polska subscribers and other operators&rsquo; subscribers.
<p>The T-Mobile Polska network structure ensures efficient expansion and reconfiguration in order to adapt to new requirements related to the developments in the telecommunications market.<br />
&nbsp;</p>

<p>Exchanges (MSC/TSC) are the basic entities in the T-Mobile Polska network. Based on their function, they can be divided into three categories:<br />
&nbsp;</p>

<ul>
	<li>Standalone &ndash; MSC (direct handling of users, they do not carry any traffic between MSCs),</li>
	<li>Transit &ndash; TSC (they transit the telecommunications traffic, but they do not handle users),</li>
	<li>Combined &ndash; MSC (they both handle the users, and transit telecommunications traffic between different MSCs.)</li>
</ul>
&nbsp;

<p>The T-Mobile Polska network consists of Transit Areas that overlap with the geographical area of Numbering Zones.<br />
&nbsp;</p>

<p>The number and location of the Points of Interconnection has an influence on the involved network elements, whose resources are used for establishing a&nbsp;connection. Therefore, based on the information on the network provided by the operator requesting telecommunication access, the actual number and location of the Points of Interconnection may be optimized.<br />
&nbsp;</p>

<p><strong>Scope of cooperation within the service of termination of SMS in the T-Mobile Polska Network</strong><br />
&nbsp;</p>

<p>The scope of cooperation concerning the service of termination of SMS in the T-Mobile Polska Network.<br />
&nbsp;</p>

<p><strong>Rules of Cooperation of the Parties</strong><br />
&nbsp;</p>

<p>1. T-Mobile Polska shall not be liable for the content of SMS (Short Message Service) text messages terminated in the T-Mobile Polska network. This also includes the use of alphanumeric representation.<br />
&nbsp;</p>

<p>2. Telecommunication traffic between the network of a&nbsp;Mobile Network Operator and the T-Mobile Polska network related to the termination of an SMS is measured both by T-Mobile Polska and the Mobile Network Operator.<br />
&nbsp;</p>

<p><strong>Compatibility</strong><br />
&nbsp;</p>

<p>T-Mobile Polska and the Mobile Network Operator will cooperate on issues related to the SMSC numbers<br />
and to ensure the compatibility of their Networks.<br />
&nbsp;</p>

<p>Technical information about cooperation with SMS termination in the T-Mobile Polska Network<br />
&nbsp;</p>

<p>1. The SMS sending service is carried out according to standards 3GPP TS 23.040 and 3GPP TS 29.002 and others pointed out in these standards.<br />
&nbsp;</p>

<p>2. The SCCP protocol is used for transmitting SMS messages between the operators. This includes the termination of SMS services.<br />
&nbsp;</p>

<p>3. The exchange of signalling traffic used for SMS termination service is performed by bundle signalling lines dedicated for handling SCCP traffic, terminated at the following Points of Interconnection:<br />
&nbsp;</p>

<p>4. It is required that at least 2 signalling link bundles connected to the Points of Interconnection specified in point 3 be set up and located in different cities<br />
&nbsp;</p>

<p>5. Rules of dimensioning and expansion of link bundles of the traffic related to the termination of the SMS service are similar to those for the bundles of SS7 links at the Points of Interconnection.<br />
&nbsp;</p>

<p>6. Only the traffic of SMS termination service and other SCCP traffic that T-Mobile Polska agreed to carry can be exchanged through the link bundles at the Points of Interconnection. T-Mobile Polska shall have the right to block traffic that is not associated with the SMS termination service, and that for which T-Mobile Polska has not agreed to transmit.<br />
&nbsp;</p>

<p><strong>Financial conditions</strong><br />
&nbsp;</p>

<p>1. The basis for billing is the number of text messages terminated in the T-Mobile Polska network &ndash; sent from the SMSC of the Mobile Network Operator and delivered through the Points of Interconnection to the T-Mobile Polska network end users.<br />
&nbsp;</p>

<p>2. For verification purposes, the Mobile Network Operator and T-Mobile Polska will record at least:<br />
&nbsp;</p>

<ul>
	<li>the time and date of sending the SMS message</li>
	<li>sender number</li>
	<li>recipient number</li>
	<li>SMSC number from which the SMS message was transmitted.</li>
</ul>
&nbsp;

<p>3. A&nbsp;message is considered delivered to the T-Mobile Polska Network when the T-Mobile Polska SMSC forwards it to the SMSC of the Mobile Network Operator and the latter SMSC acknowledges the reception of the message.<br />
&nbsp;</p>

<h2>Terms of use of the T-Mobile Polska Public Land Mobile Network</h2>
<br />
In order to provide telecommunications access for the provision of termination services on the network, the Operator and T-Mobile Polska are obliged to the rules related to the use of the network.
<ul>
	<li>each operator is responsible for its own network and is required to operate its network and establish rules of cooperation with third parties in such a&nbsp;way as not to cause damage or interference to the networks of other operators;</li>
	<li>each operator ensures the smooth operation of their network and is responsible for maintaining the correct performance of the devices on their side of the Physical Points of Interconnection and for the correct operation of their network connection points;</li>
	<li>in the event of an accident/failure, provided that this does not affect the attainment of network connections of other operators, issues shall be resolved by the operator of the faulty equipment;</li>
	<li>no operator will be allowed to connect, or agree to connect to their network, any networks of other operators or equipment that do not meet the requirements of the law.</li>
	<li>each operator is obliged to terminate calls in the T-Mobile Polska network only through the Points of Interconnection. The Operator shall not use an FCT device for this purpose.</li>
</ul>


Terms of use of the T-Mobile public land and mobile network

<h3>T-Mobile Polska, as part of the cooperation between telecommunications access operators, provides the basic service of network termination in the T-Mobile Polska network. This service is defined as a&nbsp;section of connection in the public land mobile T-Mobile Polska network from the Points of Interconnection to the called party within the T-Mobile Polska network.</h3>

<h5>The correct implementation of call termination services in the T-Mobile Polska network depends on the fulfilment of the basic technical conditions related to:</h5>

<ul>
	<li>
	<h5>the quality of the telecommunication traffic provided to the T-Mobile Polska network;</h5>
	</li>
	<li>
	<h5>SS7 signalling in the T-Mobile Polska and the Operator&rsquo;s networks;</h5>
	</li>
	<li>
	<h5>telecommunication traffic registration at Points of Interconnection;</h5>
	</li>
	<li>
	<h5>terms of exchanging telecommunication traffic.</h5>
	</li>
</ul>

<h3>Technical specifications related to the quality of the traffic provided.</h3>

<h5>Telecommunications traffic realized as a&nbsp;network connection should meet the following quality parameters:</h5>

<ul>
	<li>
	<h5>the blocking access for dial-up connections ratio to operator networks, assuming compliance with principles of traffic exchange, measured during the Peak Traffic Hours, for each of the points of networks connections, cannot exceed 5%. The blocking of access to the operator networks is understood as not processing a&nbsp;call by a&nbsp;given network according to the following criteria:</h5>
	</li>
	<li>
	<h5>no response to the SS7 IAM signalling packet;</h5>
	</li>
	<li>
	<h5>request of link release, if the release cause relates to the codes of 010 class (ITU-T Q.850 recommendation).</h5>
	</li>
	<li>
	<h5>The numerical value of the access blocking rate (ratio of blocked calls to the total number of call attempts which are routed to the Points of Interconnection) shall be counted every Working Day during 1 hour of the peak traffic hour in the operator networks.</h5>
	</li>
</ul>

<h5>The ratio will be monitored 24/7 in total, separately for each direction. Any deviation or degradation of this ratio must be clarified by both sides.</h5>

<h3><strong>Technical specification related to the SS7 signalling</strong></h3>

<ol>
	<li>
	<h5>To handle telecommunications traffic between the networks of operators, the SS7 ISUP signalling system version 1 will be used.</h5>
	</li>
	<li>
	<h5>The change of the signalling system for handling telecommunications traffic between T-Mobile Polska and operator exchanges to the SS7 ISUP version 2 system can be made with prior agreement between the parties</h5>
	</li>
</ol>
&nbsp;

<h3>Terms of telecommunication traffic recording</h3>
&nbsp;

<ol>
	<li>
	<h5>Mutual settlements between T-Mobile Polska and the Operator in respect to telecommunications traffic exchange will be based on the registered traffic.</h5>
	</li>
	<li>
	<h5>Each Operator is required to install, at their own expense, the necessary equipment for recording telecommunications traffic, the data from which will be the base for settlements. Registration of telecommunications traffic connections will be carried out by operators in a&nbsp;continuous manner.</h5>
	</li>
	<li>
	<h5>The basis for determining the fee for each connection is the Real Connection Time. No fees shall be collected for not connected traffic and connections routed to standard verbal announcements</h5>
	</li>
	<li>
	<h5>Settlements for telecommunications traffic will be made on the basis of Real Connection Time, expressed in minutes calculated in a&nbsp;billing period, keeping in mind that a&nbsp;billing period is a&nbsp;calendar month..</h5>
	</li>
	<li>
	<h5>In the case of settlement of SMS traffic, the basis for settlement is the number of SMS messages terminated in the T-Mobile Polska network &mdash; sent from the SMSC of the Mobile Network Operator and delivered through Network Connection Points to the T-Mobile Polska network end users.</h5>
	</li>
	<li>
	<h5>For verification purposes, the Mobile Network Operator and T-Mobile Polska will record at least:</h5>
	</li>
	<li>
	<h5>An SMS message is considered delivered to the T-Mobile Polska Network when the T-Mobile Polska SMSC confirms reception of the message by the SMSC with the SMSC of the Operator.&rdquo;</h5>
	</li>
</ol>

<ul>
	<li>
	<h5>time and date of sending the SMS message;</h5>
	</li>
	<li>
	<h5>sender number;</h5>
	</li>
	<li>
	<h5>recipient number;</h5>
	</li>
	<li>
	<h5>SMSC number from which the SMS message was transmitted.</h5>
	</li>
</ul>
&nbsp;

<h3>Terms of exchanging telecommunication traffic</h3>

<h5>As part of cooperation between operators, the exchange of telecommunications traffic will be carried out according to the following rules:</h5>

<ul>
	<li>
	<h5>connections initiated and terminated in the Operator network will not be realized by the T-Mobile Polska network;</h5>
	</li>
	<li>
	<h5>telecommunications traffic of the Operator is received at the T-Mobile Polska exchange associated with an Interconnection Point;</h5>
	</li>
	<li>
	<h5>telecommunication traffic should be directed according to the T-Mobile Polska Transit Areas. in each T-Mobile Polska Transit Area, at least one possible location of the Point of Interconnection has been defined.</h5>
	</li>
	<li>
	<h5>if the network of any operator becomes the source of overloads on another network, the other operator shall be entitled to immediately introduce appropriate traffic limits in order to guarantee the required quality of traffic for its end users, as well as users of other operators connected to the operator network, and correct operation of network devices;</h5>
	</li>
	<li>
	<h5>in case of an overload at the T-Mobile Polska Point of Interconnection, the Operator has the right to route telecommunication traffic through alternative means of connection. Detailed rules for telecommunications traffic management will be specified in the agreement for telecommunications access.</h5>
	</li>
	<li>
	<h5>any Operator with which T-Mobile Polska cooperates agrees to route inter-network traffic and expand the bundles so that no more than 5% of the Total Connection Time generated by the Operator in a&nbsp;month be transferred through the networks of other operators, and that this is considered Excessive Traffic. The above apply to the termination of connections in the T-Mobile Polska network.</h5>
	</li>
	<li>
	<h5>The Operator undertakes not to route SMS traffic incoming from subscribers (this does not apply to subscribers of networks of the Parties using international roaming) using networks of other operators to T-Mobile Polska through a&nbsp;Network Connection Point.</h5>
	</li>
	<li>
	<h5>The Operator undertakes not to route SMS traffic to subscribers of T-Mobile Polska in other way than through a&nbsp;direct Network Connection Point.</h5>
	</li>
</ul>
&nbsp;

<h3>Forecasting of telecommunication traffic</h3>

<h5>In order to maintain an optimum volume of T-Mobile Polska network resources used for the exchange of telecommunications traffic during the cooperation between operators, the Operator will be required to submit forecasts of telecommunications traffic.</h5>

<h5>The mechanism forecasting telecommunications traffic incoming to the T-Mobile Polska network involves the Operator delivering, once every six months (in January and July of each calendar year), forecasts for the next 12 months relating to telecommunications traffic incoming to the T-Mobile Polska Network.</h5>

<h3>Technical information about cooperation on SMS termination in the T-Mobile Polska network</h3>

<h5>The SMS termination service in the T-Mobile Polska network involves delivering SMS messages originated in the Mobile Network Operator network or by the end user of the Mobile Network Operator, who currently is in active roaming in another network, to the T-Mobile Polska network end users.</h5>

<h5>Delivering an SMS message to an end user of the T-Mobile Polska network means transmission, through the T-Mobile Polska network, of an SMS message originating in the Mobile Network Operator network or by an end user of the Mobile Network Operator who currently is in active roaming in another network, received from the SMS centre of the network of the Mobile Network Operator, to:</h5>

<ul>
	<li>
	<h5>The end user of the T-Mobile Polska network in the T-Mobile Polska network.</h5>
	</li>
	<li>
	<h5>The end user of the T-Mobile Polska network in active roaming in a&nbsp;another network if the T-Mobile Polska network is responsible for delivering the SMS message to that user, i.e. if the SMS Home Routing functionality is used to deliver this message.</h5>
	</li>
	<li>
	<h5>The end user of a&nbsp;telecommunications entrepreneur providing services in mobile public telephone network using radio network infrastructure of the T-Mobile Polska network if the T-Mobile Polska network is responsible for delivering the SMS message to that end user, i.e. if the SMS Home Routing functionality is not used by the entrepreneur to deliver this message.</h5>
	</li>
</ul>

<h5>In order to provide the telecommunications access for the provision of SMS termination services, the Operator and T-Mobile Polska are obliged to comply with the following rules related to the use of the network:</h5>

	<h5>T-Mobile Polska shall not be liable for the content of the SMS messages terminated in the T-Mobile Polska network. This also includes use of alphanumeric IDs;</h5>
	</li>
	<li>
	<h5>the telecommunications traffic between the network of the Operator and the network of T-Mobile Polska related with the termination of SMS messages is measured both by T-Mobile Polska and the Mobile Network Operator;</h5>
	</li>
	<li>
	<h5>T-Mobile Polska and the Operator will cooperate in matters related with the SMSC numbers and to ensure the compatibility of their networks within this scope;</h5>
	</li>
</ul>

<ul>
	<li>
	<h5>The SMS sending service is carried out according to the standards: 3GPP TS 23.040 and 3GPP TS 29.002 as well as others, specified in these standards;</h5>
	</li>
	<li>
	<h5>the SCCP protocol is used for sending SMS messages between the operators, including for performance of the SMS termination service;</h5>
	</li>
	<li>

	<h5>only the traffic related with the SMS termination service and other SCCP traffic that T-Mobile Polska has agreed to may be exchanged through the link bundles at Network Connection Points through which exchange of signalling traffic will be taking place. Technical information about cooperation on call termination

<p>After signing the agreement for telecommunications access, upon the request of the Operator, the process related to the implementation of the Point of Interconnection will begin. The implementation of the Point of Interconnection consists of the following basic steps:</p>

	<li><strong>Examination of the request to build a&nbsp;new Network Connection Point</strong>&nbsp;&mdash; 3 weeks;</li>
	<li><strong>Bilateral arrangements regarding the new Network Connection Point</strong>&nbsp;&mdash; 2 weeks;</li>
	<li><strong>Arrangements regarding a&nbsp;space lease agreement at the T-Mobile Polska location</strong>&nbsp;&mdash; 4 weeks;</li>
	<li><strong>Building of transmission by T-Mobile Polska&nbsp;</strong>&mdash; 5 weeks;</li>
	<li><strong>Connecting the trial configuration</strong>&nbsp;&mdash; 2 weeks;</li>
	<li><strong>SS7 signalling tests and connection recording tests</strong>&nbsp;&mdash; 5 weeks;</li>
	<li><strong>Network Connection Point upgrade to the target configuration</strong>&nbsp;&mdash; 2 weeks;</li>

</ol>

<p>If it is not necessary to perform one of the tasks specified above, the building and launch process is shortened respectively by the duration of this task. At the same time, T-Mobile Polska and the Operator will strive to execute the transmission with the use of their own resources. Nevertheless, in special cases, supporting transmission by a&nbsp;third party shall also be allowed. The period for building the transmission may exceed 5 weeks for reasons independent of the Parties.</p>

<p>Upon the commercial launch of the Network Connection Point, telecommunication traffic can be exchanged.</p>

<p>Points of Interconnection between the T-Mobile Polska network and the Operator network will be created based on the E1 links bundle. The minimum configuration of the Point of Interconnection is made of 2 E1 links and 2 C7 channels (understood as timeslots of 64kbit/s size).</p>

<p>Before the commercial launch of the Network Connection Point, T-Mobile Polska and the Operator conduct functional tests. After receiving positive test results, bundles at the Network Connection Point are initiated.</p>

<h2>Collocation mode</h2>

<p>Collocation mode is aimed at Operators who wish to provide all telecommunications infrastructure between the commutation nodes of T-Mobile Polska and the Operator network. In the implementation of Point of Interconnection based on Collocation, we distinguish the following components of connection:</p>

<ul>
	<li>a transmission link fed by the operator to the T-Mobile Polska ODF on the line;</li>
	<li>a telecommunication device installed in the Operator&rsquo;s cabinet or T-Mobile Polska cabinet;</li>
	<li>optical and electrical connection points originating from the Operator&rsquo;s device terminated at T-Mobile Polska&rsquo;s distribution frames.</li>
</ul>

<h3>Technical specifications for implementation of the Collocation mode</h3>

<p>The Operator builds a&nbsp;Physical Point of Interconnection in the Collocation Mode based on the technical and organizational conditions provided by T-Mobile Polska and based on the project of the telecommunication devices installation of the Operator approved by T-Mobile Polska. The cost of adapting the T-Mobile Polska telecommunications infrastructure for the implementation of a&nbsp;Physical Point of Interconnection will be covered by the Operator requesting the Physical Point of Interconnection.</p>

<p>A minimum of 8 E1 connections must be requested in order to implement the Collocation mode at the Physical Point of Interconnection.</p>

<p>The Operator on its own and at its own expense shall prepare an installation draft, perform all work related to the entry of telecommunication cables to the T-Mobile Polska object, routing cables inside the building, and terminating cables at the T-Mobile Polska distribution frame. At the same time, the Operator is responsible for the installation work of telecommunications equipment and for making connections between the device and the T-Mobile Polska distribution frames.</p>

<p>T-Mobile Polska undertakes the provision of technical and organizational conditions necessary to carry out construction of the Physical Point of Interconnection, supervise on-going works and provide space on the T-Mobile Polska distribution frames to be used for the implementation of the network connections.</p>

<p>Telecommunications equipment installed within the Collocation Mode can be used for making connections only to network elements belonging to T-Mobile Polska.</p>

<p>T-Mobile Polska allows the implementation of the Collocation Mode based on fibre optic cables entering into a&nbsp;T-Mobile Polska object and de-multiplexing service (no need for installing the transmission equipment of the Operator).</p>

<h3>Insurance in the Collocation mode</h3>

<p>Having an insurance policy guaranteeing coverage of any damages arising from the works performed by the Operator on the T-Mobile Polska site is required for implementation of the Point of Interconnection in the Collocation mode. In particular, the scope of the insurance policy should cover any insurance claims that may be made due to the operation of the Operator&rsquo;s equipment at the site, as well as the work of the Operator&rsquo;s staff on the T-Mobile Polska telecommunications infrastructure or of other operators with equipment present at the site.</p>

<h3>Collocation</h3>

<p>Within the building of Physical Points of Interconnection, T-Mobile Polska performs the following activities and processes:</p>

<ul>
	<li>
	<p><strong>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</strong><strong>Technical Analysis &ndash;&nbsp;</strong>verification of the technical possibilities for the construction of the Physical Point of Interconnection;</p>

	<p><strong>&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</strong><strong>Supervision of Operator works &ndash;&nbsp;</strong>supervision of the installation and coordination of the works related to the construction of the Physical Point of Interconnection;</p>
	</li>
	<li>
	<p><strong>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</strong><strong>Termination of the Fibre Optics at the T-Mobile Polska ODF &ndash;&nbsp;</strong>activity consisting in allowing the Operator to terminate their Fibre Optics at the T-Mobile Polska ODF;</p>
	</li>
	<li>
	<p><strong>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</strong><strong>Termination of the cables at the T-Mobile Polska DDF &ndash;&nbsp;</strong>activity consisting in allowing the Operator to terminate their cables at the T-Mobile Polska DDF;</p>
	</li>
	<li>
	<p><strong>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</strong><strong>Preparation of the T-Mobile Polska telecommunication infrastructure for Collocation &ndash;&nbsp;</strong>the service encompasses all the works related to the preparation of the T-Mobile Polska telecommunication infrastructure for installation of the Operator&rsquo;s devices at a&nbsp;given T-Mobile Polska site.</p>
	</li>
</ul>

<p>&nbsp;</p>

<p><strong>Within the maintenance service of Physical Points of Interconnection, T-Mobile Polska performs the following services (recurring services):</strong></p>

<ul>
	<li><strong>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</strong><strong>Area sharing &ndash;</strong>&nbsp;the service consists in the provision of space for a&nbsp;telecommunication Operator cabinet. The size of the shared area for the telecommunications cabinet &ndash; the projection of the area taken up by the telecommunications cabinet together with the service area (front and rear access to the cabinet seen as a&nbsp;square with sides equal to the width of the cabinet);</li>
	<li><strong>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</strong><strong>Electricity &ndash;&nbsp;</strong>the use of electricity by Operator devices installed at the site is calculated according to the following formula: Rated power of the devices x 24 x 30 x rate for kWh;</li>
	<li><strong>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</strong><strong>STM-1 stream de-multiplexing (regardless of the number of 2 Mbit/s streams) &ndash;&nbsp;</strong>the services consist of the sharing of a&nbsp;T-Mobile Polska de-multiplexer for crossing the 2Mbit/s streams;</li>
	<li><strong>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</strong><strong>Access to other parts of the T-Mobile Polska telecommunications infrastructure &ndash;&nbsp;</strong>the service consists of the provision of T-Mobile Polska telecommunications infrastructure (cable wells, entries, etc.) for the implementation of the Physical Point of Interconnection</li>
</ul>

<p>Fees for the above activities/processes carried out by the T-Mobile Polska within the Collocation Mode are defined individually.</p>

<h2>Lease of the Transmission Link mode</h2>

<p>The Transmission Link Lease is aimed at those Operators who wish to establish connection to the T-Mobile Polska network based on transmission links installed and leased from T-Mobile Polska.</p>

<p>&nbsp;</p>

<p>T-Mobile Polska distinguishes two types of transmission link leases:</p>

<ul>
	<li><strong>Transmission Link Lease at the STM-1 level with de-multiplexing &ndash;&nbsp;</strong>providing the Operator with a&nbsp;transmission link of STM-1 bandwidth, de-multiplexed at the T-Mobile Polska exchange to the level of E1,</li>
	<li><strong>Transmission Link Lease at the E1 level &ndash;&nbsp;</strong>providing the Operator with a&nbsp;transmission link of E1 bandwidth.</li>
</ul>

<p>The condition for implementation of a&nbsp;Point of Interconnection in the Link Lease Mode by T-Mobile Polska is that the Operator each time verifies and accepts the technical conditions at the T-Mobile Polska site and covers the costs of starting of the Transmission Link Lease service (Installation fee).</p>

<p>In the case of a&nbsp;Link Lease at the E1 level, the Physical Point of Interconnection is created on a&nbsp;digital distribution frame (DDF) and is compliant with the ITU-T G.703 standard.</p>

<p>In the case of a&nbsp;Link Lease at the STM-1 level, the Physical Point of Interconnection is created on an optical distribution frame (ODF) or in the cable well. The Interface of the Point of Interconnection of SDH technology should be compatible with the G.957 standard.</p>

<p>Fees for the above activities/processes carried out by T-Mobile Polska in the Transmission Link Lease mode are defined individually.</p>

<h2>Tests related to the initation of Points of Interconnection</h2>

<p>Before the commercial initiation of a&nbsp;Point of Interconnection, T-Mobile Polska and the Operator conduct functional tests according to the ITU-T recommendations, as well as billing tests. Positive test results allow for the upgrade of the Point of Interconnection to the target configuration.</p>

<p>The conducted tests aim at confirming:</p>

<ul>
	<li>the compliance of technical parameters and communication and synchronization protocols,</li>
	<li>the correctness of supporting all kinds of inter-network connections which are intended to be established during tests (mutual arrangements required),</li>
	<li>the correctness and compliance of connections recording in inter-network traffic with respect to the agreed services.</li>
</ul>

<h2>Services related to the activation and use of inter-network bundles</h2>

<p>After the transmission link is launched, switching operations essential for the initiation of the Point of Interconnection are implemented. The test configuration is initiated, which allows the execution of SS7 signalling tests and connection recording tests. Finally, after receiving positive tests results, the Point of Interconnection is upgraded to the target configuration.</p>

<p>Within the use of the Point of Interconnection, the number of signalling and user links may be expanded or reduced, if need be.</p>

<p>Within the activation of inter-network bundles, the following services have been defined:</p>

<ul>
	<li><strong>creation of a&nbsp;bundle</strong>&nbsp;&ndash; a&nbsp;service consisting in the creation of a&nbsp;bundle of links from the T-Mobile Polska exchange to the Operator exchange at the Point of Interconnection;</li>
	<li><strong>removal of a&nbsp;bundle</strong>&nbsp;&ndash; a&nbsp;service consisting in the removal of a&nbsp;bundle of links from the T-Mobile Polska exchange to the Operator exchange at the Point of Interconnection;</li>
	<li><strong>creation or removal of an E1 link in a&nbsp;bundle</strong>&nbsp;&ndash; a&nbsp;service consisting in the creating or removal of an E1 link in an existent bundle of links at a&nbsp;Point of Interconnection.</li>
	<li><strong>creation of a&nbsp;signalling data link</strong>&nbsp;&ndash; a&nbsp;service consisting in the launching of a&nbsp;signalling link from T-Mobile Polska&rsquo;s Signalling Point of Interconnection to STP or to the exchange of the Operator.</li>
	<li><strong>removal of a&nbsp;signalling data link</strong>&nbsp;&ndash; a&nbsp;service consisting in the removal of a&nbsp;signalling link from T-Mobile Polska&rsquo;s Signalling Connection Point to STP or to the exchange of the Operator.</li>
	<li><strong>execution of a&nbsp;network interconnection, measurements and handing over for use</strong>&nbsp;&ndash; actions aimed at launching the interconnection of networks, including repeated measurements (if required) made so that the Point of Interconnection can be handed over for use.</li>
</ul>

<p>&nbsp;</p>

<p>Within the use of inter-network bundles, the following services have been defined:</p>

<ul>
	<li><strong>subscription fee for access to the T-Mobile Polska network (2 Mbit/s port)</strong>&nbsp;&ndash; a&nbsp;service available in the T-Mobile Polska commutation network which consists in providing access to the E1 commutation port in the T-Mobile Polska exchange, to which a&nbsp;2Mbit/s link is connected in order to establish a&nbsp;Point of Interconnection with the Operator;</li>
	<li><strong>subscription fee for access to a&nbsp;64kbps signalling channel linked to the T-Mobile Polska exchange</strong>&nbsp;&ndash; a&nbsp;service of access to the T-Mobile Polska network providing access to the C7 signalling terminal in the T-Mobile Polska exchange, to which a&nbsp;64 kbps signalling link is connected in order to establish a&nbsp;Point of Interconnection with the Operator;</li>
</ul>


Implementation of network connection points

<p>T-Mobile Polska and the Operator shall be obliged to maintain the correct functioning of a&nbsp;Point of Interconnection and immediately remove any Failure or Fault under its jurisdiction after its detection or after receiving a&nbsp;relevant failure notification from the other operator.</p>

<h4>Failures and faults at the Point of Interconnection</h4>

<p>In the case of faults resulting in the reduction of quality parameters below the threshold, or Failures, the Operator who noticed the Fault or Failure will immediately inform the other operator by phone, fax, e-mail or other way specified in the agreement between T-Mobile Polska and the Operator covering the provision of telecommunication access.</p>

<h4>Point of Interconnection Dimensioning</h4>

<ol>
	<li>If during the period of 1 (one) month the use of links at the given NCP does not exceed 30%, the Parties shall take actions aiming at reducing the number of links at that NCP or at closing it.</li>
	<li>If during the period of 5 subsequent business days the average use of links at an NCP exceeds 80%, the Parties shall take immediate actions aimed at extending the number of links at that NCP.</li>
	<li>The use of links at an NCP shall be calculated as the mean of maximum daily traffic values at PTH from the last 5 (five) business days, divided by the available traffic on the links, calculated from the reverse of the Erlang B formula, with the blocking probability of 0.5%. The number of links used in calculations shall be measured at the end of the measurement period.</li>

At the same time, it should be emphasised that regulations following from the SMP decision have no legal effect between the obliged mobile network operators and operators from outside the European Union.</h5>

Fees for the activities/processes related to the implementation of the Point of Interconnection in the Collocation Mode and the Transmission Link Lease Mode are defined individually.<br />
<br />
An operator requesting the provision of telecommunications access must provide complete financial statements and legalization documents. Based on these documents, the financial credibility of the Operator is evaluated, and a&nbsp;decision is made about the need for a&nbsp;security deposit, the type of deposit and its amount.<br />
<br />
To protect against claims arising from agreement concluded by T-Mobile Polska for telecommunications access, the Operator, before the commercial launch of a&nbsp;Point of Interconnection, must present the financial securities specified above. The amount of securities is calculated based on the forecasted traffic transmitted by the inter-network E1 connections, the payment cycles and the applicable rates.<br />
<br />
If there is a&nbsp;need to use more links, the amount of financial securities may be increased. The amount and form of the security submitted by the Operator may change depending on the traffic volume and timeliness of the payment by the Operator, and its financial condition.<br />
<br />
In case of payment delays by the Operator, T-Mobile Polska claims the right to block inter-network traffic. T-Mobile Polska will provide notice in writing of this at least two weeks in advance.<br />
<br />
This information does not constitute an offer within the meaning of the Civil Code provisions. The final rules detailing cooperation, billing, form and amount of the securities will be determined through negotiations taking into account the specifics of the selected telecommunications solutions and will be formalized by the signing of an agreement for network connection.</h5>
